Overview
#introThese Terms govern WASHD CAR LLC ("WASHD," "we," "us") detailing, cleaning, ceramic coating and associated booking services in Hawaiʻi. Your confirmed booking, accepted service description, approved changes and applicable written warranty identify what you buy.
Please read the relevant limitations before booking. Nothing here excuses damage caused by our failure to use reasonable care or removes rights that cannot lawfully be waived. Physical-damage concerns follow Section 9; coating-performance claims follow the applicable written warranty.
1) Who we are, authority & your agreement
#1You must be at least 18 and own the vehicle or have the owner's or lessor's authority to approve the work. Give accurate vehicle, condition, contact and access details, including required rental or lease permissions.
These Terms apply when presented to and accepted by you through booking or another recorded agreement. Merely viewing a page does not authorize a charge or subscription. We may retain the accepted version, service description and approvals. Later website changes do not rewrite existing bookings.
Identify any person authorized to approve changes or collect your keys. A person being near your vehicle does not automatically give them that authority. Fleet or commercial work may also be governed by a separately accepted agreement.
2) Booking, timing, access & safety
#2- Confirmation and timing. Your booking confirmation confirms the appointment. Arrival and completion times are estimates unless expressly guaranteed. We communicate material delays. Reserved time does not permit omitted work or unlimited labor.
- Safe, authorized location. Provide lawful parking, sufficient working space, property permissions, keys and access. Not every street, parking area or enclosed garage permits or safely accommodates mobile work. We retain our own legal and safety duties.
- Availability. Be reachable or designate an authorized contact. Agree key return before work. See Section 5 for no access.
- Personal items. Remove valuables, documents, loose belongings and items blocking cleaning. Tell us about anything that must not be moved or discarded. We may leave obstructed, locked or unsafe areas untreated after explaining the limitation; a material scope change requires agreement. We do not inventory vehicle contents or automatically treat belongings as trash.
- Work area. Keep people and animals outside the work area and follow safety instructions. We pause work for equipment, heat, electrical, exhaust or other hazards.
- Vehicle movement. Moving your vehicle requires separate express authorization and a suitably authorized driver. Giving us keys for cleaning is not permission for off-site driving. We may request that you reposition the vehicle instead.
3) Steam process, products & site compliance
#3Our process uses low-water steam and appropriate detailing products or other agreed cleaning methods. Steam can produce moisture or condensation. Low-water or eco-friendly does not mean chemical-free or suitable for every surface or location.
We select methods for the material and condition, follow product instructions and may test first. We will not discharge contaminated wash water unlawfully. Required containment, ventilation and safety controls must be practical before work proceeds.
We may decline unsuitable work and explain alternatives. Customer permission does not override safety or compliance duties.
4) Service scope, pricing, approvals & payment
#4- Booked scope. The accepted package and add-ons define the work. Deep restoration, disassembly, correction and specialist treatments are included only when expressly listed or later approved. We cannot retroactively remove an included task by labeling it an add-on.
- Declining extra work. Where safe and feasible, keep the original service with explained limitations, approve a revised scope, or discuss rescheduling or cancellation. Declining an optional upgrade alone carries no penalty. We pause tasks without a safe, agreed scope.
- Authorized limit. We will not exceed your approved scope or charge without further approval. Additional conditions discovered during work require the same process. A schedule conflict alone does not justify charging for unfinished work.
- Prices and invoice. Prices are in U.S. dollars. Any applicable tax or disclosed tax pass-through and approved fees are identified in the agreed total and final invoice. Voluntary tips are not added without your authorization. Promotions apply as accepted at booking.
- Cashless payment. You authorize the disclosed deposit or pre-authorization and the charge for completed, approved work and properly applicable disclosed fees to your selected payment method. Deposits are credited to the balance, not charged twice. An unfinished service is settled under Section 6.
- Holds and failed payments. A hold is not a settled charge; your bank controls release timing. We may retry a declined authorized payment only as permitted by applicable law and payment-provider rules, with any required notice. An unpaid amount does not authorize unrelated charges.
5) Cancellations, reschedules & no access
#5This policy protects reserved time, travel and preparation. Deadlines use Hawaiʻi time. An expressly agreed, more favorable booking arrangement controls.
Detailing: Interior / Exterior / Refresh / Deluxe & add-ons
- At least 48 hours before the scheduled start: cancellation or rescheduling is free.
- Last-minute cancellations, including same-day cancellations: if you cancel less than 48 hours before the scheduled start and decline rescheduling, we may charge or retain $100 — the same fee as a no-show. Rescheduling instead avoids this cancellation fee, subject to availability.
- No-show or no access: a $100 missed-appointment / dispatch fee may apply when we attend as arranged but cannot access the vehicle. We will make at least two contact attempts and allow at least 15 minutes from arrival, never starting that wait before the scheduled arrival window. A later or missed arrival by WASHD is not treated as your no-show. We may credit this fee to a rescheduled booking.
Ceramic coating: 5-Year / 10-Year / Lifetime
- At least 48 hours before the scheduled start: cancellation or rescheduling is free.
- Within 48 hours: if you cancel and decline rescheduling, we may retain 20% of the deposit as the scheduling and preparation fee, returning the balance. This is not 20% of the service price. Deposit requirements must be disclosed before payment.
- No access: after the contact attempts and waiting period above, the coating cancellation arrangement applies; we do not add the detailing $100 fee on top.
Weather and our cancellation. If we judge weather or the site unsuitable, we offer a free reschedule. If WASHD cancels and you decline rescheduling, the deposit for unperformed work is returned. Our equipment failure or inability to deliver does not trigger a cancellation penalty.
No duplicate recovery. Fees must be disclosed and lawful. Cancellation and no-show fees are not stacked for the same appointment. We do not recover the same loss twice or assume an unsafe site is your fault. Unused prepayments, less any proper fee, are returned. Part-completed work follows Section 6.
6) Completion, quality concerns, refunds & disputes
#6Completed, properly performed services are final for change-of-mind purposes. This does not excuse omitted work, defective performance, unauthorized charges or failure to meet an express commitment.
Inspection and correction
Inspect at handover. Report an apparent cleaning-quality concern promptly to info@washdcar.com, preferably within 24 hours, with your booking reference, explanation and available photos. This helps distinguish original issues from later use; it does not automatically forfeit valid claims, including problems not reasonably discoverable sooner.
For a verified failure in included work, our first response is inspection and no-charge correction of the affected area, not an automatic repeat of the entire package. We aim to arrange correction within 14 days of the offer or another reasonable agreed date.
If correction is unsafe, impractical, unreasonably delayed or does not reasonably resolve the included service failure, we will provide an appropriate proportionate remedy, including a refund for affected work where warranted or legally required. A credit may be offered by agreement; it does not replace a refund you are legally entitled to. Declining an offer does not automatically extinguish other rights.
- Completion. Completion means finishing the agreed tasks or approved revised scope and notifying you, not merely reaching the end of a slot. Your absence does not prevent charging for completed work or waive valid concerns.
- Outside the correction policy. A change of mind, accurately disclosed limitation or new contamination does not itself entitle you to a refund or repeat service. Ordinary use or third-party work does not automatically defeat an unrelated original defect.
- Damage and warranties. Suspected physical damage follows Section 9. Coating-performance concerns follow the applicable written warranty, not the preferred 24-hour cleaning-quality reporting period.
- Customer-requested early stop. We may charge for completed, approved work and products reasonably consumed, plus a separately applicable disclosed cancellation fee, without duplicate recovery and never above the approved booking total. This is not a penalty for stopping unsafe or materially defective work.
- Work interrupted by us or weather. We offer to finish without extra charge or settle for properly completed work only. Payment for unsupplied work is returned unless you choose to retain it toward rescheduled work. There is no double charging.
- Site or access interruption. We explain what can be completed and agree the remaining scope, timing and price. Only completed, approved work and properly applicable disclosed fees are payable; no double charging applies.
- Billing errors. Duplicate, incorrect and unauthorized charges are reviewed and corrected promptly. Refunds normally return to the original payment method; legally required cash redemption and an unavailable original method are handled appropriately.
Payment disputes and management decisions
Please contact us about billing concerns. You may exercise lawful card-issuer and payment-dispute rights without exhausting our process. We may submit accurate, relevant booking, approval and performance records in response.
A reversal does not by itself decide every contractual issue, but neither does it automatically authorize recharging you, adding a penalty or treating a disputed debt as proven. Any collection must have a lawful basis, follow applicable rules and avoid double recovery. Collection costs are recoverable only when lawfully due, not automatically under these Terms.
Management-approved exceptions should be confirmed in writing through an official WASHD channel. A goodwill gesture is not an admission of liability or a change to every future booking. Nothing here negates a representation or promise that is legally binding.
7) Results, treatment limits & aftercare
#7We use reasonable care and skill. Results depend on material and condition. Unless expressly agreed, treatment does not promise complete removal of stains, odors, pet hair, smoke residue, water spots, etching, oxidation or every imperfection.
- Cleaning versus restoration. Deep staining, discoloration, material loss, prior repairs or deteriorated finishes may need restoration or replacement beyond the booked cleaning. We explain an observed limitation rather than promise a result we cannot support.
- Separate treatments. Paint correction, glass water-spot removal and other specialist tasks are separate unless included in your accepted order. Polishing is not repainting. A wax or sealant service is not a ceramic coating; the product type and included surfaces are those agreed for your booking.
- Persistent concerns. Repeating treatment may not improve a condition safely. We may stop, propose a limited result or recommend a specialist instead of risking further damage. Your approval does not require an unsafe method.
- Aftercare. Follow supplied drying, ventilation, curing and care instructions; ask if unclear. New contamination, improper care or environmental exposure is assessed by its actual effect, not used to excuse poor workmanship.
- Examples and estimates. Illustrative photos and estimated times do not guarantee identical results. Specific service descriptions and legally binding representations remain effective.
8) Vehicle condition, sensitive services & key return
#8Existing condition and inspection
Disclose known repainting, touch-ups, loose parts, failing finishes, leaks, damaged seals, electrical issues, chemical treatments and aftermarket installations. We may document inspection and before/during/after photos. Visual inspection is not mechanical diagnosis and may miss hidden defects.
Cleaning may reveal an obscured condition; visibility after cleaning alone does not establish causation. We pause affected work when appropriate, document observations and assess the evidence.
WASHD is not responsible for a pre-existing or latent condition, or independent deterioration, to the extent our work did not cause or worsen it through a failure to exercise reasonable care. This qualification also applies below; a condition acknowledgment does not release careless work.
- Paint, films and trim. Disclose repairs, exposed edges, unstable clear coat, wraps, paint-protection film, tint and loose accessories. We may test, reduce treatment intensity or exclude an unsafe area by agreement. We do not promise removal of deep defects without material loss or replacement.
- Interior materials. Headliners, adhesives, leather coatings, soft-touch finishes, brittle plastics and previous repairs require assessment. We may limit moisture, heat, extraction or agitation and explain the resulting scope. Seat, panel, restraint or other component removal is not included unless separately agreed and safely within our capability.
- Engine bays and electronics. These services require specific approval. Disclose known faults, exposed wiring and non-original equipment. We use methods appropriate to the accessible components and avoid unsuitable exposure of sensitive parts. An electrical fault or aftermarket installation is not an automatic waiver of responsibility for damage we cause.
- Headlights and glass. Restoration is limited to the treatment agreed; it is not a promise of permanent clarity, repair of internal defects, or replacement of damaged glass or lenses.
Child seats and restraint systems
We accept cleaning only after checking the applicable manufacturer's instructions and agreeing which parts and methods are permitted. We will not steam, chemically treat, soak or otherwise clean a safety component contrary to those instructions. If compatibility cannot be verified, that work is declined.
We do not uninstall, reinstall or rethread child restraints or certify their safety or installation. The caregiver is responsible for removal, reinstallation and fit checks according to the seat and vehicle manuals; a certified Child Passenger Safety technician can assist. This does not excuse damage caused by improper cleaning.
Mold, pests, bodily fluids and odors
Disclose suspected mold, infestation, bodily fluids, sharps, chemical contamination or other hazards before service. We may require assessment, appropriate precautions and an approved scope and price, or decline work beyond our safe capability.
Our detailing is not licensed pest-control work, comprehensive mold remediation, medical disinfection or a certification that a vehicle is free of pathogens or safe to occupy. Unless specifically agreed, treatment covers only accessible, identified areas; hidden contamination, underlying leaks and replacement of affected material are outside the scope. We do not guarantee complete elimination or non-recurrence and may recommend an appropriately qualified specialist.
Ozone and restricted-entry treatments
Ozone requires separate approval after the procedure, limitations, risks and re-entry instructions are explained. Ozone can harm people, animals and sensitive materials; it is not a universal sterilization method. People and animals must stay out until treatment, ventilation and verification of appropriate re-entry conditions are complete. Lack of odor or a fixed waiting time alone does not prove safety. We decline treatment when exposure cannot be controlled safely.
Ceramic coatings and written warranties
The written warranty and service order provided before purchase identify the product, coated and covered surfaces, term, issuer, exclusions, claim procedure and required maintenance. Review WASHD's coating warranty and your booking-specific documents. Coating a surface does not automatically mean that surface has the same warranty as painted body panels.
A "Lifetime" package has the meaning stated in its accepted written warranty, not unlimited protection from every cause. Coatings are not protection against every scratch, chip, accident or environmental condition. Follow the supplied curing and care instructions. Any required paid maintenance and its pricing basis must be disclosed before purchase and remain subject to applicable law.
Written warranty obligations are not removed by our general final-sales policy, a short cleaning-complaint reporting request, or a blanket warranty disclaimer. Treatment failures and alleged damage are assessed under the appropriate process. Service-history reporting, when included and authorized, is not a guarantee of resale value or third-party warranty coverage.
Secure key return
Agree direct handover, an authorized recipient or another approved secure return method before work. We do not leave keys in an unlocked vehicle because you are unavailable. If the method fails, we contact you or your delegate and escalate to management.
We document the agreed handover and vehicle security. Completion of cleaning alone does not release us from responsibility for keys still in our custody. No undisclosed waiting or key-return fee is automatically added. After a properly completed secure handover, new loss unrelated to our acts or omissions is not our responsibility.
9) Suspected physical damage & evidence
#9Report suspected damage promptly after discovery to info@washdcar.com, preferably within 48 hours of discovery. Include the booking reference, observations, discovery date and available evidence. A problem not reasonably discoverable sooner is not automatically barred.
- Inspection opportunity. Allow reasonable inspection by WASHD and, when appropriate, our insurer or an independent specialist. We may request relevant records and estimates. You may obtain independent advice; WASHD is not the sole judge of a claim.
- Preserving evidence. Where practical, preserve the area and original evidence for inspection. Do not delay urgent safety repairs or reasonable mitigation. Document those steps, retain relevant invoices and parts where reasonable, and notify us promptly.
- Causation and scope. We assess condition, methods, work, timing and relevant evidence. Discovery timing alone does not establish fault; a missing pre-service photo does not conclusively defeat a claim.
- Appropriate remedy. Responsibility is for loss attributable to our acts or omissions under applicable law. A repair estimate is not automatic approval of an unrelated upgrade or a complete-vehicle restoration. Reasonable necessary repairs, matching work and other legally recoverable loss are assessed on their merits, not capped at the price of a detail under Section 18.
- Independent events. We are not responsible for unrelated later accidents, vandalism, wear, third-party work or contamination. That exclusion does not excuse damage we caused or a loss aggravated by our failure to use reasonable care.
These requests do not replace statutory deadlines or restrict urgent action, insurance claims, independent advice or legal rights.
10) Service messages & optional marketing
#10We use the contact details you provide for lawful appointment, access, payment and service communications. Promotional SMS/MMS requires the separate consent applicable to that messaging; accepting service terms alone is not marketing consent. Marketing consent is not a condition of purchase.
Message frequency varies and message/data rates may apply. Reply STOP to opt out or HELP for assistance; you may also contact info@washdcar.com. We honor revocation requests as required by law. Where needed, service arrangements can be coordinated through an available non-marketing channel.
Provide a number you are authorized to use and keep contact details current. Message delivery is not guaranteed.
11) WASHD+ memberships, plans & renewal
#11Recurring billing requires affirmative consent. At enrollment we disclose the chosen price, monthly or annual billing interval, renewal timing, cancellation method and material benefit restrictions, and provide a confirmation you can retain. The chosen plan renews until cancelled; this page alone does not enroll you.
- Cancel renewal. Cancel through your account or email info@washdcar.com before the next renewal charge. We confirm cancellation; a timely cancellation is effective without waiting for staff to read or confirm it. A charge made after a timely cancellation is corrected.
- Paid term. Cancellation normally stops future billing and leaves access through the paid term. We do not ordinarily prorate for a voluntary mid-term cancellation or unused benefits, except where required by law or otherwise agreed. This does not permit retaining payment for a plan we fail to supply.
- Renewals and changes. We send required renewal reminders and advance, retainable notice of material changes, including how to cancel. We do not retroactively reduce benefits already purchased or apply an increased recurring charge without the notice and consent required by law.
- Benefits. Eligible vehicles, household use, booking availability, credit rules, redemption limits and any requirement to purchase a qualifying service with a complimentary treatment must be disclosed at enrollment. Benefits are non-transferable except as expressly offered. Priority booking does not guarantee a particular slot.
- Maintenance appointments. A membership is not unlimited cleaning or a standing authorization for separately chargeable work. A recurring maintenance-service plan requires its own agreed scope, frequency, price and cancellation terms. Cancelling one arrangement does not silently cancel a separately confirmed service; each cancellation method must be clear.
- Credits and discontinuation. Purchased value is distinguished from promotional credits under Section 12. If WASHD discontinues a paid membership, unused prepaid access is refunded proportionately unless you choose an alternative. Any treatment of fraud or nonpayment must preserve applicable rights and properly account for prepaid amounts.
12) Gift cards, certificates & credits
#12- Purchased value. Electronic gift cards are valid for at least five years and paper-only certificates for at least two years, or longer where applicable law requires. An expiration must be disclosed. Where no expiration is stated, the purchased value does not expire.
- Fees. No dormancy, inactivity or service fees apply. Any legally permitted initial issuance fee must be disclosed before purchase and remain within applicable limits.
- Small balances. You may request cash redemption when the remaining gift-card or certificate balance is less than $5.00, or whenever otherwise required by law.
- Lost or stolen. Protect gift-card details. We may reissue verified remaining value after confirming ownership and preventing duplicate use; value already legitimately redeemed cannot be redeemed again.
- Promotional credits. Genuinely free promotional credits may have the restrictions and expiration disclosed when issued, where lawful. Purchased gift value, prepaid services and other protected balances are not converted into forfeitable promotional credits merely by labeling them "credits."
Gift cards are not ordinarily refundable or redeemable for cash except as described above or legally required. Unauthorized resale or promotional use is prohibited, without reducing a lawful holder's statutory rights.
13) Promotions, referrals & coupons
#13Offers cannot be combined unless expressly permitted. Eligibility, exclusions and any expiry are those disclosed with the offer; accepted booking prices are not retrospectively increased because an offer later changes. Later promotions do not automatically reduce an earlier agreed price.
We may investigate and reasonably suspend suspected fraudulent or duplicate promotional redemptions, explain the issue and correct errors. Restrictions on a misused promotion do not automatically forfeit unrelated purchased value or valid consumer rights.
14) Our team & official service channels
#14Services may be performed by employees or appropriately engaged contractors. That status does not itself exclude WASHD's responsibility for work it agrees to provide. Book WASHD services and confirm material changes through our official channels.
Privately arranged, unauthorized side work is not automatically a WASHD booking or backed by WASHD's service commitments. This does not remove responsibility for conduct attributable to WASHD under applicable law. Any separate commercial restriction requires its own lawful agreement.
15) Weather, interruptions & right to refuse
#15Weather, humidity, wind, site conditions, emergencies or events outside reasonable control may make work unsafe or unsuitable, especially coating application. We may delay, stop or reschedule and will communicate material changes. Safety-related reschedules initiated by WASHD are free; payment for unperformed work is handled under Section 6.
We may refuse work that is illegal, outside our safe capability, or involves threats, harassment or unsafe interference. Refusal is not a penalty for a good-faith complaint, honest review or lawful payment dispute. Any decision remains subject to applicable nondiscrimination and consumer-protection requirements.
Neither party is responsible for a reasonable delay genuinely caused by an event beyond its reasonable control. This does not excuse avoidable negligence, allow retaining payment for unprovided services, or remove an applicable refund or cancellation right.
16) Operational records, privacy & photo use
#16We may retain relevant booking, approval, service and vehicle-condition records for performance, quality, safety, billing and claims purposes, consistent with our Privacy Policy and applicable law. We limit unnecessary identifying content and access, and may share relevant records with authorized service providers, insurers, payment providers and advisers where permitted. This is not consent to covert audio recording or unrestricted surveillance.
Public marketing use of identifiable customer or vehicle images requires separate permission. Declining marketing use does not affect service. You may withdraw permission for future use; we will stop new use and reasonably remove material we control, while explaining any limits involving copies outside our control. Necessary operational records may still be retained.
Service-history reporting is performed only when included, authorized and appropriately disclosed. Data used for that purpose should be accurate and limited to what is needed. Contact us to report an error or exercise applicable privacy rights.
17) Intellectual property
#17Do not misuse WASHD branding or protected original materials, or falsely suggest affiliation. Lawful quotation, personal records, evidence and honest reviews remain permitted. You retain ownership of your reviews.
18) Responsibility, warranties & liability limits
#18We remain responsible for reasonable care and skill. A result limitation or condition acknowledgment is not a release for damage caused by our negligence. Our agreed service commitments, applicable express warranties and rights that cannot lawfully be waived remain in force.
Limited economic claims. To the extent lawful, liability for a purely contractual economic claim about a service is limited to the amount paid for the affected service, together with any return of unearned prepayments. The correction and proportionate-refund process in Section 6 applies. For those limited claims only, we exclude speculative profits and indirect business losses to the extent legally permitted.
Important exceptions. Those caps and exclusions do not apply to personal injury, death, damage to a vehicle or other property, negligence, gross negligence, reckless or intentional conduct, fraud, legally binding written-warranty remedies, statutory consumer remedies, or any liability that cannot lawfully be limited. Legally recoverable loss of use arising from property damage is not excluded by treating it as an indirect loss.
Digital availability. Digital availability is not guaranteed uninterrupted; paid-service and refund obligations remain. No "as is" statement cancels a written warranty or legally binding promise.
19) Disputes, governing law & venue
#19Please contact info@washdcar.com with a concern so we can seek a practical resolution. Informal discussion does not prevent urgent relief or contact with regulators or payment providers. It does not extend legal deadlines by itself.
Hawaiʻi law governs these Terms, subject to any mandatory law that applies. Disputes may be brought in the courts of competent jurisdiction in Honolulu, Hawaiʻi, including small claims where eligible, except where applicable law requires or permits a different forum that cannot be excluded by agreement.
No mandatory arbitration, class-action or jury-trial waiver is imposed. Honest reviews, good-faith complaints and exercising legal rights carry no penalty.
20) Versions & future updates
#20The version and revision date are shown above. A booking is governed by the version presented and accepted for that booking, together with its approved service documents. A later update does not add exclusions or shorten claim rights for earlier work.
We provide advance, retainable notice of material changes affecting ongoing plans and obtain further consent when required. Revised terms govern future bookings only when properly presented and accepted. Continued browsing alone does not authorize new charges, retroactive changes or a subscription.
21) Other terms & document priority
#21These Terms and the accepted service order, approved changes, plan terms and applicable written warranty form the service agreement. Mandatory legal rights take priority. A specifically agreed service term controls its subject; an applicable written warranty controls covered warranty performance. General wording does not erase a specific promise or a representation that the law makes binding.
If a provision fails, the remainder continues where lawful. A one-time exception is not a general waiver. A business transfer cannot reduce paid benefits, accrued rights or warranties. Customer transfers require agreement unless otherwise permitted by the offer, warranty or law.
Keep your confirmations, approvals, receipts and warranty. Ask us for your booking's terms version or to resolve discrepancies. See the Privacy Policy for personal-data handling.
